Custody, Visitation and the Right to Participate in Important Decision-Making
Texas refers to parents as conservators while Arkansas refers to parents as custodians. In Texas, the parent awarded custody of the child is designated as the sole managing conservator and has the right to determine domicile of the child. The parent given visitation rights is called the possessory conservator. If parents are awarded joint custody in Texas, they are called join managing conservators. In Arkansas, having custody of a minor child may mean legal custody, which is the right to make major decisions affecting the child’s life (e.g., regarding religion, medical care, education), or physical custody, which is the actual possession and control of the child, or both. “Joint custody” can mean either joint legal custody (parents share in the decision-making, but the child remains w/one parent), or join physical custody (child divides time between each parent’s home), or both.
